Adult Survivors Act
The Adult Survivors Act became effective on November 24, 2022. The act applies to lawsuits by a person over 18 at the time of an alleged sexual offense.
The Act provides that a case for damages for any intentional or negligent act by a person for physical, psychological, or other injuries to a person over the age of 18 as a result of conduct that would constitute a sexual offense can be brought regardless of when the alleged sexual act occurred. Therefore, the statute of limitations is eliminated for sexual offenses against a person over 18.
Claims under the Adult Survivors Act must be brought within one year of the effective date. Therefore, such claims must be brought before November 23, 2023.
