Successful Opposition to Petition for Certiorari in the United States Supreme Court

We were retained by an attorney as appellate counsel to oppose a petition for writ of certiorari in the Supreme Court of the United States in a case presenting important issues under the Americans with Disabilities Act. We successfully argued for denial of the petition, bringing the case to a satisfactory conclusion.

Obtained Unanimous Rulings from the Second Circuit Court of Appeals

We were retained by an attorney to provide representation before the United States Court of Appeals for the Second Circuit in two cases involving the Americans with Disabilities Act. In both cases we obtained unanimous rulings in our client’s favor. In one of these cases the Second Circuit panel not only reversed the trial judge’s decision but took the extraordinary step of remanding the case to a different district court judge for further proceedings.

Successful Appellate Representation Before the New York Court of Appeals

We argued before the Court of Appeals (New York’s highest court) in a case in which the court recognized, for the first time, the existence of a private remedy under an important New York consumer protection statute.

Successful Representation Before the Appellate Division, First Department

We were retained by a corporation to defend against a suit by minority shareholders. After we won a motion to dismiss in the trial court, the plaintiff’s appealed to the Appellate Division, First Department. A unanimous appellate panel found for our clients. The opinion, Prichard v. 164 Ludlow Corp., 854 N.Y.S.2d 53 (1st Dep’t 2008), is available here. We were also successful in defending an Appeal by the City in judgment we obtained in the NYS Supreme Court overturning penalties assessed by the NYC Campaign Finance Board. This case established important precedence in connection with regulation of State Campaigns.
